mIRC with no spyware
my antivirus catched mIRC.exe it says to its spyware
it cant be repaired
can I download somewhere version of mIRC where is no spyware?

There is no spyware, your antivirus just detects it as a threat since people can send you files through it.

If you get mIRC from the Official site you'll have no problems. It's virus free, and if your antivirus says that it's not, you've either got a shitty antivirus, or you've got a virus elsewhere on your computer that's infecting mIRC.
