I just downloaded toribash 3.8 on my new comp running vista ultimate 64, and I can't even start it, it crashes right away. I've tried run as admin and that doesn't help.

Seems like Vista has some problems with Toribash.
Do you have aero on?
If you dont, then try activating it, or the opposite.

whatever Aero is, I don't have it, so I can't even try it. oh well, I'll just wait a while for a working version to come out, I have an older version on my laptop anyway

Did you try /set mod classic?

Also where are you trying to set it: multiplayer or singleplayer?

my toribash shop doesn't seem to be working, i have 3.8 obviously, and shaders don't want to work, when i check the box, it just unchecks after i click ok, please help.
